The agreement
These terms are an agreement between you and StagePath. By creating an account or using StagePath you agree to them, to our Privacy Policy, our Community Guidelines and our Copyright Policy. If you do not agree, do not use StagePath. Artists who distribute music or sign up as a service provider also accept the agreements shown at that point.
Your account
- You must be at least 13, or older where the law where you live requires it. If you are under 18, you need your parent or guardian’s permission, and they agree to these terms for you.
- Give accurate information and keep your password safe. You are responsible for what happens in your account.
- You may hold more than one account (for example a personal account and an artist or brand account) up to the limit shown in the app. Do not create accounts to get around a suspension or to fake engagement.
- Do not impersonate anyone. Verification badges are given by StagePath and cannot be sold or transferred.
Your content
You own what you create. When you post, upload or share content on StagePath, you keep your rights in it. You grant StagePath a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, stream, display, distribute, adapt (for example to make previews and different formats) and promote it, on StagePath and in StagePath’s marketing, for as long as it is on StagePath and as needed to operate the service. If you upload music, you also allow other members to use it as a sound in videos they make inside StagePath, as described in the upload warranty in our Copyright Policy.
You are responsible for having all the rights needed in what you share. Content you delete is removed from public view; copies other members made within the app features you allowed (such as a video using your sound) may remain.
Rules
Follow our Community Guidelines. In particular, do not:
- upload content you do not have the rights to, or infringe anyone’s copyright, trademark, privacy or other rights;
- harass, threaten, exploit or endanger anyone, especially minors;
- inflate plays, followers or engagement with bots, click farms, paid schemes or multiple accounts;
- spam, scam, phish or distribute malware;
- scrape StagePath or access it in ways other than through our apps or an agreed integration (see our API Terms);
- interfere with or try to get around StagePath’s security.
Coins, passes, purchases and refunds
- Coins and passes are a limited licence to use features inside StagePath. They have no cash value, cannot be exchanged for money outside StagePath, and expire if your account is closed.
- Purchases through the App Store or Google Play are subject to Apple’s or Google’s terms, including their refund policies. Other purchases are refundable only where required by law or stated at the time of purchase.
- Prices and fees are shown before you confirm. Prices may include taxes where required.
Earnings, royalties and payouts
- Earnings come from qualified activity only. Plays from bots, click farms, loops or other artificial means do not count.
- New earnings are held for a verification period before they can be withdrawn. The holding period is shown in your wallet.
- Before a payout we must verify your identity and collect the tax information the law requires.
- We may audit activity on your account. If we detect artificial streaming, fraud or a copyright claim, we may void the affected activity, freeze your wallet and withhold payouts while we review it, and recover amounts paid out for activity that did not qualify.
- Splits you agree in a Studio Workspace or a release are how earnings are shared. Make sure they are right before you confirm.
Bookings, events and collaboration
- StagePath connects artists, creators, venues and fans. Agreements for bookings, sessions and events are between the people involved; StagePath provides the tools, payments and escrow.
- Booking payments are held in escrow and released as milestones are approved. Ticket sales are settled to organisers after the event, less the fees shown.
- Event organisers are responsible for their events, including safety, licences and refunds if an event is cancelled.
- In a Studio Workspace each collaborator keeps the rights in their own contribution, subject to the splits and agreements made in the workspace.
Distribution and publishing
If you choose to distribute a release to streaming services or register compositions, StagePath works with partners such as TooLost and TuneRegistry. You authorise us and them to deliver and register your music as you instruct, and the partners’ terms shown at that point also apply.
Suspension and closing your account
You can close your account at any time from Settings or at Delete my account. We may remove content or suspend or close accounts that break these terms or the law, or that put our members or StagePath at risk. Where we can, we will tell you why and give you a way to appeal. Earnings that are properly yours will be paid out according to these terms, unless they are connected to fraud or infringement.
Disclaimers and limits on liability
StagePath is provided as is and as available. To the extent the law allows, we do not promise that it will always be available, error free or meet your needs, and we are not liable for indirect, incidental, special or consequential losses, or for content or conduct of other members. Our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and 100 US dollars. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer.
Responsibility for your content
If someone brings a claim against StagePath because of content you shared or your breach of these terms, you agree to cover the reasonable costs and losses that result, to the extent the law allows.
Disputes and governing law
Please contact us first at legal@mystagepath.com so we can try to resolve any problem informally. These terms are governed by the laws of the place where StagePath’s operating company is established, without regard to conflict of laws rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts.
Changes
We may update these terms as StagePath evolves. We will tell you about significant changes in the app or by email before they take effect. If you keep using StagePath after a change takes effect, the updated terms apply.
